Print this page As part of the Strengthening Medicare and Repaying Taxpayers Act of 2012 (the SMART Act), the Medicare Secondary Payer Recovery Portal (MSPRP) has been modified to permit authorized users to notify the Benefits Coordination & Recovery Center (BCRC) that a specific case is approaching settlement and request that the case be a part of the Final Conditional Payment process. This notification must be provided on the Medicare Secondary Payer Recovery Portal (MSPRP).
As a Final Conditional Payment case, you can be assured that disputes submitted on the MSPRP will be addressed within 11 business days and you will be provided with a time and date stamped final conditional payment amount.
By selecting this action, the case will become a Final Conditional Payment case and you will be required to:
- Request your Final Conditional Payment Amount on the MSPRP within 120 calendar days from today,
- Settle the case within 3 business days of requesting your Final Conditional Payment Amount, and
- Submit your settlement information on the MSPRP within 30 calendar days of requesting your Final Conditional Payment Amount.
This action can only be selected once per case. This action is not available if:
- The Final Conditional Payment Process has already been selected.
- The user is not the identified debtor or authorized representative for the identified debtor.
- The case has Ongoing Responsibility for Medicals (ORM) that has not been terminated.
- There is already an existing case for the same incident.
- The Fixed Percentage option has already been selected for this case.
- The Self-Calculated Conditional Payment Amount option has already been selected for this case.
- The case is a No-Fault case.
- A Conditional Payment Notice (CPN) has been issued.
- The case is included as part of a BCRC Special Project.
